Nobody likes a joke thief Print E-mail

By now, most of us have heard about the battle going on between two of the biggest names in stand-up comedy, and we’ve seen the footage of Joe Rogan calling out Carlos Mencia at The Comedy Store in L.A. The feud, which has everyone talking, started when Rogan accused Mencia of being a notorious joke thief.

For those who don’t know, Carlos Mencia has become successful most recently with his Comedy Central show “Mind of Mencia” and Joe Rogan is the host of “Fear Factor” and former star of “News Radio.” Any comedian can tell you joke stealing is a very serious accusation. For most comedians, the writing and development of material is a much harder part of the comedic process than actually performing the material. That is why we get very upset when we hear a comedian may have skipped the hardest part of the creative process by stealing material that other comics have struggled to perfect, especially when the accused comedian is cashing in big with the stolen jokes.

At first you may want to pass off Rogan’s attack as just the type of thing that happens from time to time between people in the business who don’t care for each other or are jealous of each other’s success. However, Rogan makes an argument complete with video proof that is hard to dispute. Mencia is accused of stealing material from comedians like Rogan, Ari Shaffir, and George Lopez. Part of the video documentation against Mencia features Lopez on The Howard Stern Show accusing Mencia of using over 13 minutes of his material on an HBO One Night Stand Special, an offense that apparently resulted in a physical altercation between the two comedians. There don’t seem to be many people sympathizing with Mencia; virtually every comedian who has spoken out on the issue has confirmed their belief that Mencia is a notorious joke thief.

Why is it that joke thieving is so rampant in comedy and so hard to prove legally? Unlike artists in the music or film industries, comedians rarely copyright their material. We trust that once we’ve written and performed a piece of material, our fellow comics will honor the unspoken gentleman’s agreement of not stealing from other comics. A problem arises when famous comedians find themselves working with comedians who are on their way up. It becomes very tempting when the more successful comedian hears a good joke from a young unknown to then use it as his own with little or no repercussions. Some comedians try to rationalize their joke theft with the argument that many comedians often think alike, so it is inevitable that two comedians will stumble upon the same premise at some point. Admittedly, this is something that could possibly happen, but occurrences should be rare. When a comedian like Mencia is being accused by a number of different comedians who have video proof to back up those accusations, this is something that should be taken very seriously in the industry.

The truth is a lot of people are good performers. I know many people who can be hilarious by acting out a comedic script on stage. The hard part about being a comedian is the writing of jokes and routines; that is the step of the creative process that separates the talent from the wannabes. Stealing and performing other comics’ material is an act of desperation by someone who lacks talent, and while it is hard to prove legally or indisputably that a comedian has stolen material, it is something that will ultimately catch up with any comedian who does it. While fans of comedy may not notice that a joke or routine has been stolen, the brotherhood of comedians will always catch it. And most of us watch out for each other. Once a comic gets the reputation of a joke thief, it won’t take long for that person to become disrespected in the business. Sadly, this is what is now happening to Carlos Mencia. Comics who steal material from other comics are like athletes who take steroids; they are looking for a shortcut to excel in their field, but they often end up taking the walk of shame.

thanks for the article. I personally think there are different kinds of talent- I know a lot of great comedy writers who can't perform a joke onstage and make it work. And i know a lot of great performer types who can't come up with their own premises but if they had writers could do really well. The part about the thievery that is so annoying is that it is STEALING. If Carlos Mencia can't write his own jokes, doesn't he have enough money to pay someone to do it for him instead of stealing material?

I know of one Chicago comic...that gets his jokes from magazines, like Maxim..not sure if this is stealing or stupid ? Obviously, you have to be able to write your own material to go far in this biz.

so he stole a few jokes...between rogan, ari and lopez he couldn't have stolen more than about 45 minutes of material. 
 
this guy has done 30 minute show after 30 minute show for seasons. plus cable specials and actual stand-up. 
 
so.......what about all the great material mencia has come up with that no one is accusing him of stealing??? 
 
is everyone ignoring that now? 
 
he may have jacked a few jokes, but the guy still has talent. some of his stuff is really his. 
 
these folks make it out to seem like mencia has never written an original word in his life.

what a theif! i agree with this article.....i used to like Carlos or Ned i should say,but after the DEE-DEE, DEE-DEE he got annoying. I can't believ he talked about mexican people, and he's not evn Mexican...IMO, he should stop before he goes even far...

I disagree with anyone who thinks its fine for someone to steal jokes as long as they're funny telling them. I also don't really agree with comedians legally buying jokes or employing writers. If you do that you are an actor not a stand-up. Performing material you didn't write is fine for tv, film, or sketch but a stand-up should be himself or at least an extension of himself on stage. if you are stealing jokes or buying jokes you are NOT a true stand-up comedian! Honestly I have very much the same opinion of musicians who don't at least write some of their own music. You are born with performance talent, the writing is the actual work that goes along with the business.

If a comic knowingly steals material, that is bad and immoral. If there happens to be similar jokes from different comics by way of coincidence, then that happens. But only the comic truly knows.

Stealing 45 minutes of material is a lot!! That's a Comedy Central special. For some comics, it can take years to come up with a solid 45 minutes. 
 
You are also being ridiculous if you think that Mencia does all of the writing for his show. He has a staff of writers. 
 
I'm sure Mencia has written some of his own material, but that's not the issue at hand. If you get caught shoplifting one item and try to explain that you did pay for a different item, then you're still in trouble for stealing the first item.

"OMG! FAKES, FAKES, FAKES" Don't you think that is a little ironic calling the people against Mencia that since his complete act and persona is fake? Whoever wrote that last comment is an idiot and obviously someone who isn't a comedian and has bad taste in comedians. I wouldn't be surprised if that last comment wasn't written by Mencia himself. The issue isn't even really about joke stealing as much as how someone who isn't even funny after stealing jokes can become famous. I wouldn't even admit he stole my jokes because he sucks.

It will be interesting to see how this unfolds. I personally don't really care much for mencia anymore. He was okay a few years ago, but then he just started getting annoying, thinking he is smart and trying to preach all the time. As for the Mexican jokes, the guy grew up with Mexicans for the most part, so if he wants to identify as one, then that's his decision. I was surpised to see how upset Rogan was. Maybe a combination of anger for the joke stealing and envy for the success of his show.

Stealing a routine is like stealing another band's song and saying it's your own because you tuned the guitars down and sung it with a different accent. 
Fuck copyright, it's about originality and respect for other artists, regardless of what form of entertainment it is. 
How can these hacks sleep at night, curled up in their dollar bills, jacking off to their HBO specials, knowing it's not even their material. 
It's rather sad actually.
